DigitalCloud Website Privacy Policy

Introduction

Baxet Group Inc. and its subsidiaries and affiliates (referred to as “Company”, “we”, “our”, or “us”) are committed to protecting and respecting your privacy. Baxet Group Inc. is a company incorporated in the State of Delaware, USA, and for the purpose of the European Union’s General Data Protection Regulation (GDPR), the relevant Baxet Group Inc. subsidiary may act as the data controller for your information.

This Privacy Policy explains how we collect, use, disclose, and safeguard your personal data when you use Company websites or any of our services – including our cloud services, Platform-as-a-Service (PaaS), Software-as-a-Service (SaaS), Virtual Private Servers (VPS), Virtual Private Network (VPN) services, and other related offerings – that link to or reference this policy. Please read this Policy carefully to understand our practices and your rights regarding your personal data.

By using our websites or services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with any part of this Policy, you should refrain from using our sites or services.

We adhere to core data protection principles such as lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, storage limitation, integrity, and confidentiality in the processing of personal data. We only process your personal data for legitimate purposes and take measures to ensure the data is relevant and limited to what is necessary, kept up to date, stored securely, and retained no longer than required.

Scope of this Privacy Policy

This Privacy Policy applies to all personal information that we collect or process about individuals who use our websites or services worldwide. It covers personal data of website visitors, account holders, and customers. It does not apply to any third-party websites or services that are linked to our site or services (see “Links to Other Websites” below for more).

Importantly, this Policy also does not cover any data that you, as a customer, may store on our servers or transmit through our services in the course of using our hosting, VPS, VPN, or other cloud offerings. In such cases, you are acting as the data controller for any personal data you upload or process, and we operate as a data processor on your behalf to provide the service.

This means we will only access, use, or process such customer-stored content as needed to deliver the services or as otherwise instructed by you, in accordance with our Terms of Service and applicable law.

Information We Collect

We collect different types of information about you when you interact with our websites and services. This may include:

Information You Provide: When you contact us (via website forms, email, or phone), create an account in our customer portal, or use our services, you may provide personal data. This includes identifying and contact information such as your name, email address, telephone number, mailing address, and other similar details.

It also includes account credentials (like username and password) and any profile information you choose to provide (for example, your organization name, date of birth, gender, or city of residence). If you make a purchase or use paid services, we collect payment and transaction information such as billing address, payment method details (e.g., credit card number or other financial information), and transaction history.

We will also collect the content of any communications you send to us, such as support requests or inquiries, and any other information you voluntarily submit through forms, surveys, or correspondence. This data is collected directly from you and you are responsible for its accuracy.

Information We Collect Automatically: When you visit our websites or use our online services, our systems automatically collect certain technical information about your device and usage of our site. This includes your IP address (which can provide a general geolocation), device identifiers or unique IDs, device type, and operating system name and version.

We also collect information about your browser type and language, the pages or screens you access on our site, the dates/times of your visits, the address of the webpage that referred you to our site (if applicable), and other standard web log information. If you use a mobile device, we might receive details about your mobile network and device. We gather some of this information through the use of cookies and similar tracking technologies (described in “Cookies and Tracking Technologies” below).

This technical data helps us administer and protect our services and to understand how you interact with our websites.

We may also receive certain information from third parties or public sources to the extent allowed by law – for example, we might receive confirmation of payment from our payment processors or updated contact information from delivery services – but in general, the personal data we process is collected from you directly or via your use of our services.

How We Use Your Information

We use the personal data we collect for the following purposes (and on the lawful bases as permitted under applicable data protection laws, such as GDPR):

To Provide and Operate Our Services: We process your information to set up and maintain your account, provide the products or services you have requested (e.g. to provision a hosting server or enable a VPN account), and fulfill our contracts with you. This includes processing orders, facilitating payments, providing technical support and customer service, and communicating with you about the services.

For example, we use contact details you provided to send service confirmations, invoices, and important notices regarding your account or the services you use. It is in our legitimate interest (and in many cases necessary for performing our contract with you) to use your data in this way to ensure our services function properly and your requests are addressed.

To Communicate with You: We use your contact information (such as email or phone number) to communicate with you about administrative or account-related matters. This includes responding to your inquiries and support tickets, sending notifications about updates or changes to services, informing you of technical issues or security alerts, and providing customer support or troubleshooting. We may also contact you to ask for feedback or to clarify details regarding your orders.

These communications are part of our services and, in general, you cannot opt out of administrative emails which are not promotional in nature.

For Marketing and Promotional Purposes: With your consent (where required by law) or as otherwise permitted, we may use your email address or other contact details to send you newsletters, offers, or promotions about our products and services or those of our affiliates that we believe may interest you. For example, we might inform you about new features, special discounts, or events.

These communications will be sent to you if you have subscribed to them or if you have made a purchase from us (subject to applicable direct marketing laws). You can always opt out of receiving marketing communications, as described in “Marketing Communications and Choices” below. We do not sell your personal information to third-party marketers, and we do not share your information with third parties for their own independent marketing purposes without your consent.

To Personalize and Improve Our Services: We use the data we collect (especially technical and usage information) to personalize your experience on our websites and to improve our services. This includes using cookies to remember your preferences (for example, language or region selection) and settings, so that we can tailor the content of our site to you. We analyze how users navigate and use our websites and platforms in order to identify trends and preferences.

This helps us to optimize site content and layouts, improve our products (for instance, by testing and developing new features or services), and enhance the overall user experience. By understanding which pages or services are most interesting or where users encounter issues, we can make our offerings more intuitive and useful.

To Ensure Security and Prevent Fraud: We are dedicated to keeping our websites, services, and user accounts secure. We process personal data to monitor for and prevent fraudulent activities, unauthorized access, hacking, misuse of our services, and other unlawful or abusive behavior. For example, we may use IP addresses and other identifiers to detect suspicious logins or behavior that might indicate fraud or a network attack.

We also may use your information to verify identity where necessary (such as during account recovery) and to enforce our Terms of Service and usage policies. These activities are in our legitimate interests to protect our business, customers, and systems, and in some cases may be necessary to comply with legal obligations (for instance, obligations to prevent money laundering or other crimes).

For Analytics and Research: We may aggregate and anonymize personal data and use it to generate insights that do not identify you. This aggregated data helps us perform research and analysis, including: understanding aggregate usage patterns, measuring the performance of our infrastructure, gauging the effectiveness of marketing campaigns, or compiling statistics about our user base.

Internal analysis of this kind allows us to make informed decisions about our business, such as how to allocate resources or which new features to prioritize, and to report on business performance. In doing so, we do not use identifiable personal information for purely analytical projects; whenever feasible, we work with de-identified or statistical data.

To Comply with Legal Obligations: We will use and disclose personal data where necessary to comply with applicable laws, regulations, legal processes or enforceable governmental requests. This includes using data to meet obligations under financial, tax, and data protection laws, or responding to lawful requests from authorities. For example, we might retain transaction records for tax auditing purposes, or disclose information if required by a court order or subpoena.

We also process personal data to maintain required records and to comply with know-your-customer (KYC) or sanctions screening obligations where they apply to our services.

To Protect Rights and Interests: We may process your information as necessary to establish, exercise, or defend our legal rights or the rights of others. This includes investigating and preventing potential violations of our terms or policies, intellectual property infringement, or other misuse of our services. We may use data to pursue available remedies or limit any damages we might sustain, for instance, by detecting activities that could be fraudulent or defamatory.

Additionally, if needed to protect the vital interests of an individual – for example, in a rare emergency situation that involves potential harm to someone’s life or safety – we might use or disclose relevant personal data to aid in preventing harm.

With Your Consent, for Other Purposes: If we intend to process your personal data for a purpose that is not outlined in this Policy, we will obtain your consent as required by law. In any situation where consent is the legal basis for processing, you have the right to withdraw your consent at any time, and we will stop the processing for that purpose.

For instance, if you consent to participate in a testimonial or case study, you can later revoke that consent and we will cease any further use of the provided information in new materials.

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for a related compatible purpose and such use is permitted by law. If we need to use your personal data for an unrelated purpose, we will notify you and explain the legal basis that allows us to do so.

Cookies and Tracking Technologies

Like many online services, we use cookies and similar tracking technologies to collect information about your usage of our websites over time and across different pages. Cookies are small data files placed on your computer or device when you visit a website. They serve a variety of functions, such as enabling certain site features, remembering your preferences, and helping us understand how users interact with our site.

Cookies allow us to recognize you when you return, count the number of visitors, and see how visitors navigate our site. This helps us to provide you with a good experience when browsing and also to improve the way the website works and our services overall. For example, cookies can remember your login information so you don’t have to re-enter it on every page, or recall your language selection so that content is presented in your preferred language.

Cookies may be session cookies or persistent cookies. Session cookies are temporary and only last for the duration of your browsing session; they are deleted from your device when you close your browser. Persistent cookies remain on your device for a set period of time or until you delete them – these allow the website to remember you on subsequent visits.

We use both types: session cookies to keep you logged in as you navigate through secure areas of the site and persistent cookies to store your preferences and other information for future visits.

We use the following categories of cookies and tracking technologies on our site:

• Necessary Cookies: These cookies are essential for the operation of our website and services. They enable core functionality such as user authentication, security, and network management. For example, necessary cookies help authenticate your account and maintain your session. You can set your browser to block or alert you about these cookies, but some parts of the site may not function properly without them.

• Preference/Functional Cookies: These cookies allow our site to remember choices you make and provide enhanced, more personalized features. They may remember your username, language or region selection, and other customizations. The information these cookies collect may be anonymized and they cannot track your browsing activity on other websites.

• Analytics and Performance Cookies: We use these to collect information about how visitors use our website, such as which pages are visited most often, and if users encounter error messages on certain pages. These cookies do not collect information that directly identifies a visitor; the information is aggregated and used to improve our site’s functionality and performance. For instance, we use Google Analytics, a popular web analytics service, to help us understand how users engage with our site.

Google Analytics uses first-party cookies to track user interactions. The data collected (such as page visits, navigation patterns, and device information) is aggregated in reports that help us analyze website traffic and usage trends without identifying individual visitors. This information helps us improve our website and services. If you do not wish to be tracked by Google Analytics across all websites, Google provides an opt-out browser add-on which you can download and install.

The add-on prevents data from being used by Google Analytics, without affecting your ability to use our site. (For more information on opting out, you can visit Google’s opt-out page here: https://tools.google.com/dlpage/gaoptout ).

• Advertising and Third-Party Cookies: As of now, we generally do not host third-party ads on our service that would plant advertising cookies. However, if in the future our website were to display advertisements or if we integrate third-party content (like videos, social media widgets, or banners) from other companies, those third parties may set their own cookies. These cookies could be used by the third parties to track the performance of their content or to remember your interaction with them.

For example, if an embedded video player from another site sets a cookie, it can observe that you watched the video. Similarly, if we ever run promotional campaigns, cookies might be used to track impressions and click-through rates of those promotions. We do not control cookies placed by third parties, and their use is subject to the privacy policies of the third-party providers.

We want to be transparent about the use of cookies and give you control. When you first visit our site (and periodically, as required), you may see a cookies consent banner or pop-up. Where required by law, we will request your consent before using non-essential cookies (such as analytics or advertising cookies). If you choose to decline certain cookies, we will refrain from setting those cookies on your device; in that case, only cookies strictly necessary for the operation of the site will be used.

Your Cookie Choices: Most web browsers allow you to control cookies through their settings preferences. You can typically set your browser to refuse all or some cookies, or to prompt you before accepting a cookie from the websites you visit. You can also delete cookies that have already been set. Please note that if you disable or refuse cookies, some parts of our site (especially login-protected areas and features that rely on cookies) may become inaccessible or not function properly.

For more information about cookies and how to manage or delete them, visit http://www.allaboutcookies.org/ , which provides detailed guidance. Additionally, if you want to prevent tracking by analytics providers or ad networks, you can consider using browser extensions or privacy settings (such as enabling “Do Not Track” in your browser) that help opt-out of certain forms of data collection.

Keep in mind that our site will respond to your browser’s signals as applicable, but the “Do Not Track” concept is not uniformly applied by all third parties.

By using our site without disabling cookies via your browser settings, you consent to our use of cookies and similar technologies as described above. You can change your cookie preferences at any time by adjusting your browser settings or, where available, through our website’s cookie management tool.

Sensitive Personal Information

We do not knowingly collect any sensitive personal information unless you choose to provide it, and we ask that you do not send us or share sensitive personal details that are not necessary for our relationship. This includes information such as your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union memberships, genetic or biometric data, health or medical information, information about your sex life or sexual orientation, or criminal background.

In particular, please do not send us government-issued identification numbers, financial account passwords, or other highly sensitive details via email or unsecured forms. If for some reason such information is needed (for example, verifying your identity for fraud prevention), we will provide a secure method for doing so and will only process it with appropriate safeguards.

Sharing Your Personal Data

We value your privacy, and we do not sell, rent, or lease your personal information to unrelated third parties for their own use, except as described in this Privacy Policy or with your explicit consent. However, in order to run our business and provide our services, we do share personal data with certain categories of recipients, as outlined below:

Affiliated Companies: We may share your information with other companies within the Baxet Group Inc. family (i.e., our subsidiaries and affiliates). These Company-affiliated companies, which could be located in the United States or in other countries, receive personal data where necessary for internal administrative purposes, for business operations, or for backup and disaster recovery. For example, if you are located outside the U.S., your data might still be stored on servers in the U.S. or accessed by our U.S. parent company for support and service delivery. All Company entities are required to follow privacy practices that are consistent with this Policy.

Service Providers and Partners: We employ trusted third-party companies and individuals to perform certain services on our behalf or to assist us in delivering our services to you. This includes, for example:

• Data hosting and infrastructure providers (to store and manage data securely),

• Payment processors (to handle credit card transactions or other payment methods securely),

• Customer relationship management (CRM) and support tools – for instance, we use Salesforce as a CRM to store customer contact information, and we may use third-party ticketing or live chat systems for customer support,

• Email and communications services to send out newsletters, alerts, and transactional messages,

• Analytics services (like Google Analytics) to help us understand how our services are used,

• Security and fraud prevention services to help us protect our platform,

• and other IT or professional service providers (such as accountants, auditors, consultants, or legal advisors) who need access to data to perform services for us.

These service providers act on our instructions and are contractually bound to protect the confidentiality and security of your information. They are only given the data necessary for them to carry out the tasks we have hired them for, and they are not permitted to use your data for any unrelated purpose. For example, if we share your email address with an email delivery service, it is solely to send emails on our behalf and not for the email service’s own marketing.

We diligently vet our vendors and require that they handle personal data in compliance with applicable data protection laws.

Business Transfers: As our business develops, we might buy, merge with, or be acquired by another company. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your personal information may be disclosed to, transferred to, or acquired by a third party as part of that transaction.

For example, if another company acquires our business or assets, personal data we have collected from our users could be one of the assets transferred. In such events, we will seek to ensure that the successor entity is bound by similar privacy standards and that you are notified of any change of ownership or use of your personal information, as well as any choices you may have regarding that information.

Legal Obligations and Safety: We may disclose your personal data when we believe in good faith that such disclosure is necessary to comply with a legal obligation, or to protect and defend our rights, your rights, or the rights of others. This includes:

• Compliance with Laws: If we are required by law to disclose data (for example, in response to a subpoena, court order, or government request), we will do so. We will also disclose information if required to respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.

• Enforcing Our Terms and Protecting Our Operations: We may share information if necessary to enforce our Terms of Service or other agreements, or to investigate potential violations thereof. We will disclose data to authorities or relevant third parties if we believe doing so is necessary to detect, prevent, or address fraud, technical or security issues, or to otherwise protect our business (including the enforcement of our contractual or legal rights).

• Protecting Rights and Safety: We might share information to protect the vital interests of our users or others. For instance, in situations involving potential threats to the physical safety of any person, or to investigate and defend against an allegation or claim against us or our personnel, we may disclose information to the appropriate authorities or parties.

With Your Consent or At Your Direction: Aside from the cases described above, you will be notified when personal information about you might be shared with other third parties, and you will have the opportunity to consent (when required by law) or to direct us to share it. For example, if you request a port-out of a service to another provider and that process requires sharing your data, or if you opt-in to a feature or promotion where sharing is necessary, we will share your data in that instance.

In all cases, we require any third party with whom we share personal data to provide an adequate level of protection for your information and to use it only for the purpose for which it was provided, consistent with this Policy and applicable law. We do not allow third parties with whom we share data to use or disclose it for their own marketing purposes, except with your express consent.

Lastly, please note that we may share non-personal, aggregated, or anonymized information freely, since it does not identify any individual. For example, we might publish reports that contain aggregated usage statistics or network performance metrics. These reports will not contain any information that could be linked back to any specific user.

International Data Transfers

Baxet Group Inc. is a global business, and as such, your personal data may be transferred to and stored in countries other than your own. Specifically, the information that we collect from you (including via our websites or through your use of our services) will likely be processed in the United States, regardless of where you are located. This is because Baxet Group Inc. has central operations and data centers in the U.S., and the primary databases for our services are located there.

If you reside in a country outside the U.S., your personal data will be transferred to, or accessed from, the United States for processing. Additionally, Company staff and our service providers may operate from multiple countries (for example, support or engineering teams in other regions), which means your data could be accessed or processed in those locations as well.

Whenever we transfer personal data out of its country of origin, we take steps to ensure that appropriate safeguards are in place to protect it, as required by applicable law. For transfers from the European Economic Area (EEA) or the United Kingdom to the United States or other countries that may not have equivalent privacy laws, we rely on recognized legal transfer mechanisms to ensure an adequate level of data protection.

These mechanisms may include, for example, the European Commission’s Standard Contractual Clauses (SCCs) or other contractual and organizational measures approved under GDPR. We have implemented safeguards such as these to protect EEA-origin personal data transferred to Baxet Group Inc. affiliates and third-party partners outside the EEA. We likewise apply similar measures for data from other jurisdictions, as needed, to maintain the privacy and security of your information.

It’s important to note that different countries have different data protection laws. When your data is transferred to another country, it may be subject to the laws of that jurisdiction (for example, accessible to law enforcement under local laws). However, our practices regarding your personal data will at all times continue to be governed by this Privacy Policy and the commitments we make herein, in addition to any specific protections required by applicable laws of the originating jurisdiction.

We will also continue to honor any rights you have under your local law (unless we have informed you otherwise).

Data Localization Requirements: In certain countries, local laws mandate that personal data of citizens be stored within that country’s territory. Company complies with applicable data localization laws, including requirements for the initial recording, systematization, accumulation, and storage of personal data in local databases.

If we transfer personal data abroad (for example, to our U.S. systems), we do so only in accordance with applicable data protection requirements and with adequate safeguards in place. If jurisdictions in which we operate impose data residency or localization rules, we will adhere to those when handling data from those regions.

Regardless of where your personal data is processed, we protect it with the same high standards. Baxet Group Inc. takes all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and applicable law during international transfers.

This includes assessing the legal environment of recipient countries and supplementing transfer mechanisms with additional technical and organizational measures as needed (for instance, encryption in transit and at rest, access controls, and policies to handle government access requests). If you have questions about our international data transfer practices or want more information about the specific safeguards we use, you can contact us (see “Contact Us” at the end of this Policy).

Data Security

We are committed to ensuring the security of your personal data. We use a combination of technical, administrative, and physical safeguards to protect the information we collect against unauthorized access, alteration, disclosure, or destruction. These measures are designed to provide a level of security appropriate to the risks of processing your personal data.

Some of the security practices we employ include:

• Encryption: We use encryption protocols to protect data transmission. For example, our websites are accessible only over HTTPS, which encrypts the data sent between your device and our servers. Sensitive information (such as payment details) is transmitted using secure encryption.

• Access Controls: We restrict access to personal data to Company employees, contractors, and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations. These authorized personnel are trained on the importance of privacy and security and are required to handle data in compliance with our security policies. Each individual’s access rights are limited to only the data and systems necessary for their job role.

• Network & System Security: We maintain up-to-date firewall protection and monitoring systems to guard against external attacks. We also employ intrusion detection and prevention systems, anti-malware tools, and vulnerability scanning to prevent and detect unauthorized system access or malicious activities. Our servers are kept in secure facilities, and we take precautions with our infrastructure (including physical security measures at data center locations) to prevent unauthorized access.

• Risk Management: We regularly review our information collection, storage, and processing practices to guard against unauthorized access, use, or disclosure. This includes conducting periodic security risk assessments and, when appropriate, engaging independent experts to test and assess the effectiveness of our security measures (penetration tests, audits, etc.). We update our practices and systems in line with evolving threats and best practices.

• Data Minimization: As part of our commitment to security, we also practice data minimization – meaning we strive to collect and retain only the personal data that we truly need to operate our business or fulfill legal requirements. Data that is not stored or that is disposed of promptly cannot become subject to unauthorized access.

Despite our efforts to protect your information, it is important to note that no method of transmission over the Internet, and no method of electronic storage, is completely secure. The internet is not 100% secure and we cannot guarantee the absolute security of your data transmitted to our site. For example, email communications are typically not encrypted, and any information you send to us via email is sent at your own risk.

We therefore urge you to take care in sending sensitive information to us via the Internet. Once we receive your data, we will apply our security measures to protect it from unauthorized access or alteration.

In the unfortunate event of a data breach that affects your personal data, we will act promptly to identify the cause and remediate the issue. Where required by law, we will notify you and/or the relevant data protection authority of certain data breaches. We maintain a breach response plan to handle such situations efficiently and in compliance with applicable regulations.

You also play a role in protecting your information. We encourage you to use a strong, unique password for your Company account and to keep it confidential. Make sure to log out of your account when using shared devices and avoid sharing personal account information with others. If you suspect any unauthorized access or activity in your account, please contact us immediately.

Data Retention

We will retain your personal information for as long as necessary to fulfill the purposes we collected it for, including to provide you with services, to satisfy any legal, accounting, or reporting requirements, and to resolve disputes or enforce our agreements. The length of time for which we keep different types of personal data may vary depending on the nature of the data and the purposes of processing.

In general, if you have an account with us or if you use our services, we will keep your personal data for the duration of our business relationship (while your account is active or while we are providing services to you), and for a certain period after the relationship ends. This post-termination retention period allows us to meet obligations that continue after the end of the contract (for instance, retaining records for tax and audit purposes, or maintaining evidence in case of legal claims).

By default, we retain personal information for approximately seven (7) years after termination or inactivity of a service or account, as this timeframe is often needed for purposes like complying with record-keeping laws and handling any potential disputes. For example, our financial records and invoices are typically kept for at least 7 years to comply with tax regulations.

However, the above is a general rule and actual retention periods can be shorter or longer based on specific circumstances:

• If a law or regulation requires us to keep certain data for a specific period (shorter or longer), we will comply with those requirements.

• If you exercise your right to deletion (see “Your Rights” below) and we have no other lawful basis to continue processing that data, we will delete the data as requested.

• We may keep data for a longer period than stated if it is reasonably necessary for active or potential legal proceedings, investigations, or regulatory issues.

• Conversely, if the information is no longer needed and no law requires us to keep it, we may delete or anonymize it sooner than the default retention period.

When we no longer have a legitimate need or legal obligation to retain your personal data, we will securely delete, destroy, or anonymize the information. We regularly review the data we hold and set deletion routines. For personal data that exists in backup systems or is not immediately practical to remove, we isolate it from normal use until deletion is feasible.

Please note that even after you delete your account or we purge your personal data from active systems, it is possible that residual data may remain in backup media for a short period (but we implement measures to ensure it is not readily accessible and will be overwritten or destroyed in due course). We also maintain anonymized or aggregated data (which is not personally identifiable) for analytical purposes, and that data may be retained longer since it does not identify you.

Your Rights

We respect your individual rights to your personal data. Depending on your location and subject to applicable data protection laws (such as the GDPR in the European Union, the UK Data Protection Act, or other global privacy laws), you have certain rights regarding the personal data we hold about you. These rights may include:

Right to Access: You have the right to request confirmation of whether we are processing your personal data, and if so, to request a copy of that personal data, as well as information about how we use it. This includes information such as the categories of data we have, the purposes of processing, the recipients or categories of recipients with whom the data has been shared, and, if possible, the envisioned period for which the data will be stored.

Providing you with your data will generally be done in electronic form. For additional copies, we may charge a reasonable fee based on administrative costs as permitted by law.

Right to Correction (Rectification): We want to ensure that the personal information we have about you is accurate and up-to-date. You have the right to ask us to correct or update any of your personal data that is inaccurate, and to have incomplete data completed. Upon your request, we will correct any errors in your personal data that we confirm. In many cases, you can also make certain changes yourself by logging into your account and editing your profile or settings.

Right to Deletion (Erasure): You have the right to request that we delete your personal data in certain circumstances. Common scenarios where this may apply include:

• The personal data is no longer necessary for the purposes for which we collected or processed it.

• You initially provided consent for processing and have now withdrawn that consent, and we have no other legal ground for processing.

• You have objected to processing (see “Objection” below) and we have no overriding legitimate grounds to continue the processing.

• We processed your data unlawfully or in violation of applicable laws.

• A law requires us to erase the personal data (for example, to comply with a legal obligation under EU or Member State law).

If none of these conditions apply, we are not required to delete your data. But if they do apply, upon a valid request we will take reasonable steps to erase your personal data (by purging it from our systems or anonymizing it) and to inform any third parties who have received it (and are processing it on our behalf) to also erase it, taking into account available technology and the cost of implementation.

Please understand that the right of erasure is not absolute – there are exceptions, such as when processing is necessary to exercise freedom of expression, to comply with a legal obligation, to perform a task in the public interest, or to establish or defend legal claims. We will inform you if any such exceptions apply when responding to your request.

Right to Withdraw Consent: Where we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. This will not affect the lawfulness of any processing that was done before you withdrew consent, but it will mean that we stop the specific processing that was based on consent. For example, if you consented to receive marketing emails, you can withdraw that consent and we will stop sending you marketing emails.

To withdraw consent, you can use the specific opt-out mechanisms provided (such as unsubscribe links in emails for marketing consent) or contact us directly. In certain cases, we may ask you to verify your identity before processing the withdrawal. If you withdraw consent for a service or feature that requires it, we may not be able to provide you that service or feature (for instance, certain optional data you allowed us to use). We will advise you if this is the case.

Right to Restrict Processing: You have the right to request that we limit or “pause” the processing of your personal data in certain situations.

This right applies, for example, if you contest the accuracy of the data (for a period allowing us to verify it), if the processing is unlawful but you oppose erasure and request restriction instead, if we no longer need the data but you need us to keep it for establishment, exercise or defense of legal claims, or if you have objected to processing (pending verification of whether our legitimate grounds override yours).

When processing is restricted, such personal data will, with the exception of storage, only be processed with your consent or for certain other limited purposes (like legal claims or public interest reasons). We will inform you when a restriction is lifted.

Right to Data Portability: For personal data that you have provided to us, you have the right, in certain cases, to receive that data in a structured, commonly used, and machine-readable format (for example, CSV or JSON) and to have that data transmitted to another data controller, where technically feasible. This right applies when: (a) the data is processed by us automated means (i.e., electronically); and (b) the processing is based on your consent or on a contract you have with us.

It does not apply to data we have derived or inferred about you (such as an internal analysis of your usage). We will provide the data directly to you, or to a third party you designate, if technically possible. Please note that exercising this right does not automatically trigger deletion of your data from our systems (you can separately request deletion if needed).

Right to Object: You have the right to object, on grounds relating to your particular situation, to the processing of your personal data in certain circumstances. If we are processing your data based on our legitimate interests (or those of a third party) or performing a task in the public interest, and you feel our processing has a significant impact on your rights and freedoms, you may object to that processing.

If you raise an objection, we will stop processing the personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or unless the processing is necessary for the establishment, exercise, or defense of legal claims. As explained below in “Marketing Communications and Choices,” you also have an absolute right to object to your personal data being used for direct marketing purposes at any time.

This includes profiling related to direct marketing. If you object to direct marketing, we will cease processing your data for those purposes immediately.

These rights are not absolute and may be subject to conditions or limitations under applicable law. For instance, if fulfilling your request would reveal personal data about another person, or if you request deletion of data that we are legally required to keep, we might not be able to comply fully. We will evaluate each request and communicate with you if any exemptions apply.

Exercising Your Rights: To exercise any of the rights above, please contact us by email at info@digitalcloud.pro. In your request, kindly specify which right you wish to exercise and the scope of the request (for example, the specific information you want to access or delete). For your protection and the protection of all our users, we will need to verify your identity before fulfilling a rights request, to ensure that we do not disclose or erase information to the wrong person.

We may ask you to provide certain information or identification to confirm that you are the owner of the data in question. Any information you provide for verification will only be used for that purpose.

We will respond to your request within the timeframe required by the law applicable to your region (for example, under GDPR we generally have one month to respond, with the possibility of extension in certain cases). If your request is unusually complex or if you have made a large number of requests, we may inform you that we need additional time. If we decline all or part of your request, we will provide you with an explanation, to the extent we are allowed to by law.

For example, we might refuse a request for erasure if retaining the data is necessary for compliance with a legal obligation, or we might decline to provide a copy of data if it would infringe on the rights of another individual. In any case, we will inform you of the main reasons for our decision and of your right to complain to a supervisory authority if you believe our refusal is not justified.

We also note that we will not discriminate against you for exercising your rights. For instance, we will not deny you service, charge you a different price, or provide a different level of service solely because you exercised any of the privacy rights described above. Your use of our services remains equal whether or not you choose to exercise these rights (aside from the effect that we may no longer be able to provide certain services if, for example, you ask us to delete necessary data).

Marketing Communications and Choices

Promotional Messages: With your permission or as otherwise allowed by law, we may send you marketing and promotional communications about our products or services. These may include newsletters, blog updates, customer surveys, information about new features or products, or special deals and offers. We may send these communications via email, and if you have provided your phone number and consented where required, possibly via SMS/text messages or other means.

We aim to communicate with you in ways that are relevant and useful; for example, existing customers might receive offers for upgrading services they already use.

Opting Out of Marketing: You have the right to object at any time to the processing of your personal data for direct marketing purposes. If you no longer wish to receive marketing emails or other promotional messages from us, you can opt out at any time. The easiest way to unsubscribe from email marketing is by clicking the “Unsubscribe” link provided at the bottom of our marketing emails. You can also contact us at info@digitalcloud.pro and request to be removed from our marketing lists.

Once we process your opt-out request, we will stop using your data for direct marketing (it may take a short time to ensure all our systems are updated, so you might receive a message or two if one was already in process, but we will strive to honor your request promptly).

If you opt out of receiving marketing communications, please note you may still receive transactional or service-related messages from us. These are not promotional; they are messages such as account notifications, password reset emails, billing statements, security alerts, and other important notices (for example, communications about changes to this Policy or our Terms of Service, or notices in the event of any service disruption).

These communications are necessary for us to provide our services and for you to be informed about critical matters, so we generally do not offer an opt-out for those types of emails.

Cookies and Advertising Choices: As described in the “Cookies and Tracking Technologies” section, you can manage how cookies are used on your browser. If we ever use cookies for advertising or if third-party advertisers are present, you can opt out of many ad network cookies through the tools provided by the Digital Advertising Alliance or Network Advertising Initiative in the U.S., or similar organizations in other countries.

Additionally, modern browsers often allow you to enable a “Do Not Track” (DNT) setting; however, our site’s behavior with respect to DNT may depend on third-party implementations, since there is not yet a common standard. We encourage you to use the cookie management options we provide and the controls in your browser.

Profiling: We do not currently use your personal data to make any automated decisions that produce legal or similarly significant effects on you (no fully automated decision-making without human involvement). We may analyze or profile data to segment our user base or tailor marketing (for example, to send relevant offers based on the services you use), but such processing is done under our legitimate interests or with consent, and you have the right to object to it.

If you object to any profiling related to direct marketing, we will cease it as described above. We do not conduct any automated processing that would have a substantial adverse impact on you without the possibility of human review.

Complaints

We hope to resolve any inquiry or concern you bring to our attention, so we encourage you to contact us first if you have a problem or complaint regarding our use of your personal data. You can reach us at info@digitalcloud.pro and we will do our best to investigate and respond as soon as possible. Our customer support and privacy team will review your complaint and may reach out to you for further information if needed.

We aim to acknowledge receipt of a complaint within a few business days and to provide a substantive response within a reasonable timeframe, depending on the nature of the issue.

If you are not satisfied with our response, or you believe we are processing your personal information in a way that is not in accordance with the law, you have the right to escalate your complaint to the relevant data protection authority or regulator. For example:

• If you are in the European Union/EEA, you can contact the supervisory authority in the country where you reside, where you work, or where the alleged infringement occurred.

• If you are in the United Kingdom, you can contact the Information Commissioner’s Office (ICO).

• If you are in a jurisdiction outside the EU/UK, you may have a local privacy or data protection regulator (for instance, in Canada the Office of the Privacy Commissioner, in Australia the Office of the Australian Information Commissioner, etc.) to which you can lodge a complaint.

This right to complain is without prejudice to any other administrative or judicial remedy you might have. In other words, you are free to contact a regulator first, or at any time, if you wish. We do kindly ask that you consider giving us the chance to address your concerns directly first, as we are committed to resolving issues in a fair and transparent manner.

Links to Other Websites

Our website and services may contain links to websites, content, or services that are not operated by Baxet Group Inc. – for example, links to our business partners, social media pages, or reference articles. If you follow a link to any third-party website or service, please note that these external sites have their own privacy policies and practices, which may differ from ours.

We do not have control over and do not assume responsibility for the content, privacy protections, or practices of websites or services that we do not operate.

We encourage you to review the privacy policy of every website you visit or external service you engage with. If you arrive at a third-party site via a link on our site, information you provide to that third party is not covered by our Privacy Policy. If you have questions about how those other sites use your information, you should contact them directly.

That being said, if you encounter any issue with a website linked from our platform (for example, if a link on our site appears to be malicious or broken), we welcome you to inform us so that we can take action if appropriate (such as removing a problematic link or notifying the third party).

Children’s Privacy

Our websites and services are not directed to children, and we do not knowingly collect personal data from individuals under the age of 13 (or the minimum age allowed by local law in your jurisdiction, if higher). We do not offer our services to minors without the consent of a parent or guardian. If you are under 13, please do not attempt to register for an account or send any personal information about yourself to us.

If we learn that we have inadvertently collected personal data from a child under 13, we will take prompt steps to delete such information from our records.

If you are a parent or guardian and you become aware that your child has provided us with personal data without your consent, please contact us immediately at info@digitalcloud.pro. We will work with you to remove the data and terminate the child’s account if one exists.

In certain cases, the minimum age may differ (for example, in the European Union, children under 16 may require parental consent for some data processing, although some countries set this age at 14 or 15). We will abide by applicable laws regarding the ability of minors to consent to data processing. Generally, we do not intentionally solicit or receive information from minors; our services (such as hosting and VPS plans) are intended for use by adults or authorized representatives of organizations.

Changes to this Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. If we make changes, we will post the updated policy on this page and update the “Last Updated” date at the bottom of this Policy. Please check back periodically to review any updates or changes.

For significant changes – especially any that materially affect your rights or how we use personal data – we will take additional steps to notify you. This may include posting a prominent notice on our website or, if appropriate, contacting you through email or via your account. For example, if we were to expand on the types of personal data we collect or introduce new purposes for processing, we would inform you in advance in accordance with legal requirements.

Your continued use of our websites or services after any changes to this Privacy Policy have been posted will signify your acceptance of those changes, provided that any required consents are obtained. If you do not agree with the changes, you should discontinue use of our services and may deactivate your account. We will not lessen your rights under this Privacy Policy without your explicit consent.

In case we ever merge or combine this Policy with other policies (for instance, if we operate multiple brands or domains with separate privacy notices that get unified), we will also communicate that clearly.
